Welcome to Discount Tijarah (“Discount Tijarah,” “we,” “our,” or “the Seller”). These Terms and Conditions (“Agreement”) govern your access to and use of our website and retail location, and your purchase of products ("Products") from us. By accessing our platform or making a purchase, you (“you,” “your,” “Customer,” or “Buyer”) agree to be legally bound by these Terms and Conditions.

1. Acceptance of Terms

By using our website or purchasing from Discount Tijarah in-store or online, you confirm that you have read, understood, and agreed to these Terms and Conditions, which together with our No Refund / No Return / No Exchange Policy and Privacy Policy, form the entire agreement between the Buyer and the Seller.

Discount Tijarah reserves the right to update or amend these terms at any time. Continued use of our services after such changes constitutes acceptance of those changes.

2. Eligibility and Purpose of Sale

You must be 18 years of age or older and have the legal capacity to enter into a contract.
Our products are primarily intended for businesses, resellers, and commercial use. Individual retail customers purchasing liquidation products must accept all terms of sale and assume full responsibility for due diligence prior to purchase.
We reserve the right to request verification of business credentials for wholesale transactions.

3. Product Listings and Descriptions

Wholesale Products are sold in volume at discounted prices for resale purposes.
Liquidation Products are sold strictly “as-is”, which may include returned, surplus, shelf-pulled, damaged, refurbished, or open-box items. No guarantees are provided regarding condition, completeness, or performance.
While we aim to ensure product descriptions and pricing are accurate, we do not warrant the reliability, completeness, or current accuracy of any listing.

4. Pricing and Payment

All prices are in Canadian Dollars (CAD) and are subject to change without prior notice.
Pricing excludes shipping, handling, taxes, or other applicable fees, which will be clearly disclosed at checkout.
We accept credit/debit cards, Interac, e-Transfers, and other electronic payment methods. Full payment must be made prior to fulfillment.

5. Shipping and Delivery

Shipping rates are calculated based on destination, weight, and method selected at checkout.
Delivery timelines are estimates only and not guaranteed. Discount Tijarah is not liable for delays caused by third-party carriers or force majeure events.
Risk of loss transfers to the Buyer upon completion of the transaction, regardless of whether the product has shipped.

6. Strict No Return, No Refund, and No Exchange Policy

All sales are final. We do not accept returns, exchanges, or issue refunds or store credits under any circumstances. This applies to all wholesale and liquidation products, whether sold in-store or online.
Buyers are strongly encouraged to inspect items in person prior to purchase. Online purchases are deemed accepted in the condition stated or shown.

7. No Warranty

All products are sold “as-is,” with no representations or warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Discount Tijarah disclaims all liability for product condition post-sale.

8. Bulk Orders and Resale Restrictions

Products purchased in bulk are intended strictly for commercial resale.
Resellers must comply with any applicable import/export or regional resale restrictions. Discount Tijarah is not liable for resale activities or resulting customer claims.

9. Limitation of Liability

To the maximum extent permitted by law:

Discount Tijarah shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profit, use, or data, arising from or related to your use or inability to use any product.
Our total aggregate liability shall be limited to the amount actually paid for the product(s) in dispute, excluding shipping, taxes, or associated fees.

10. Force Majeure

Discount Tijarah shall not be held liable for failure to perform any obligation where such failure is due to events beyond our reasonable control, including but not limited to acts of God, labor disputes, supply chain disruptions, civil unrest, or regulatory changes.

11. Intellectual Property

All content on the website—including logos, product images, design elements, text, and software—is the property of Discount Tijarah or its licensors and is protected by intellectual property laws. No use, reproduction, or distribution is permitted without prior written consent.

12. Privacy and Security

Your use of our site and services is also governed by our Privacy Policy, which outlines how your information is collected, used, and protected. You agree to review this policy prior to completing a transaction.

13. Termination of Access

Discount Tijarah reserves the right to restrict, suspend, or terminate your access to the site or services at its sole discretion if you violate these terms, misuse the platform, or engage in fraudulent or unlawful activity.

14. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the Province of Ontario, Canada. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Hamilton/Stoney Creek, Ontario.

15. Amendments

We reserve the right to update these Terms and Conditions at any time. The revised version will be posted on our website with the updated effective date. It is the buyer’s responsibility to review the terms periodically.

By making a purchase through Discount Tijarah, either online or in-store, you confirm that you have read, understood, and agreed to these Terms and Conditions in their entirety.

NO REFUND, NO RETURN, NO EXCHANGE POLICY

Discount Tijarah is committed to providing quality products at highly competitive prices. Due to the nature of our inventory—which includes wholesale, liquidation, surplus, refurbished, and closeout items—we maintain a strict No Refund, No Return, and No Exchange policy. By completing a purchase with us, whether online or in-store, you acknowledge and agree to the terms set forth in this Policy.

1. Binding Agreement

By purchasing from Discount Tijarah, the customer affirms that they have read, understood, and accepted this policy. This policy forms a binding part of the terms of sale and applies to all transactions unless explicitly and contractually agreed otherwise in writing by an authorized representative of Discount Tijarah.

2. Inspection Prior to Purchase

All customers are strongly encouraged to inspect all merchandise prior to purchase. Products are sold strictly "as-is, where-is" with no warranties, guarantees, or assurances, express or implied, as to condition, merchantability, suitability, or fitness for a particular purpose.

By completing any purchase, the buyer assumes full responsibility for assessing the item’s condition and suitability and waives any post-sale claim or right to recourse.

3. No Refunds

All sales are final. No refunds will be issued under any circumstances, including but not limited to dissatisfaction with product condition, incorrect selection, or delayed delivery.
Payment Disputes: In the event of a chargeback or reversal initiated by the buyer without merit, Discount Tijarah reserves the right to pursue all available remedies, including legal action to recover funds, interest, and administrative or legal costs. Future business may be declined.

4. No Returns

Discount Tijarah does not accept returns for any reason, including for unopened, damaged, defective, or unwanted items. This applies equally to online and in-store purchases.
Product condition is disclosed to the best of our knowledge at the time of sale. Customers assume all risk and liability once the transaction is complete.

5. No Exchanges

We do not offer exchanges under any circumstances. If you select the wrong product or later change your mind, we are unable to accommodate substitutions or replacements.
It is solely the buyer’s responsibility to ensure product suitability and completeness prior to purchase.

6. Liquidation Product Disclaimer

Sold As-Is: All liquidation inventory is sold in “as-is” condition. These items may be used, returned, open-box, refurbished, cosmetically flawed, or missing components.
Condition Disclosure: While Discount Tijarah makes reasonable efforts to describe products accurately, no guarantee is made regarding completeness or performance.

7. Order Cancellation

Once an order is placed, it cannot be canceled, altered, or modified. This applies to both in-store and online orders.
Shipping and handling fees are non-refundable. Orders canceled prior to processing (where permitted) may be subject to an administrative fee.

8. Customer Acknowledgment

By placing an order, the customer acknowledges:

That they have read and understood this No Refund, No Return, and No Exchange Policy;
That they accept all risk associated with purchasing liquidation and wholesale items;
That they waive any right to seek redress, exchange, return, or refund after the transaction is completed.
